Buy Shotgun, Someone Knocks At Your Door To Check Purchase, Call 911, Hilarity Ensues...

July 7, 2020 incident in which ATF Agent James Burk attempted to make contact with a member of the Columbus, Ohio community, who then called 911. When Columbus PD officers Joseph Fihe and Kevin Winchell arrived, Agent Burk did not comply with their commands, even at gunpoint. The officers tased Agent Burk in the process of subduing him. Agent Burk - who in 2015 was charged with shoplifting wine from a Kroger grocery story - is now suing the officers for excessive force.

    Federal Agent, thinks his stuff don't stink. Well, buttercup, "you can't talk to a man with a shotgun in his hand" and you sure as heck better be compliant. I've see other videos where the Fed complies, and all is well after signals/credentials are exchanged. Being rude with a 'tude doesn't get you very much but grief. And pain. Ad maybe a 9mm headache, although I prefer .357 hot load JHP.

  5. I want to see one of those stupid LEOs yell at another LEO to drop and get face down and if they don't immediately drop they get shot. Every one of those officers was WAY OUT OF LINE. They treat the people who pay their stupid salaries like they were third world refugees and they are the Gestapo. This entire "officer safety" crap needs to end. If you're a cop but you don't feel safe - too bad. The Constitution does not protect your "right" to "feel safe". It protects ME.

    1. But he's a cop, so it doesn't protect him, just you? He's not a citizen, entitled to the same rights as you? I'm former San Diego PD (as a young man), and I would have complied to keep us all from making a mistake - just as this F-Trooper should have. Fed cops have a real "better than thou" attitude when they deal with street cops or deputies. I laughed MAO watching him snivel. I'd buy those two cops whatever they wanted to drink, all night long.

  6. I think I laughed out loud when he started pulling the 'I can't breathe' and then said something about his wife being pregnant (what??). Dumbass brought every bit on himself by thinking he was above the law and by being a bully. Lady in the apartment did the right thing. He wasn't acting legit.

    I do bleeve this is the first Excessive Use of Force lawsuit I ever saw that I don't give a damn which one wins. But it did result in an ATF demi-god getting his ass tazed, and for now, that's enough.

  12. Agent Burk devolved into the same ridiculous blather that, it appears, all standard criminals do, "I can't breath", I have a medical condition. Hilarious. Local officers should have liberally applied the aluminum night stick to his blunt skull for good measure. In my estimation, Agent Burk should not be allowed carry a firearm since his obvious lack of professionalism exhibits a distinct tendency to over react, and if he were just confronted by a civilian he would jump to violence in a heartbeat. He should be demoted to just office mail delivery and stripped of authority to carry a weapon, or just plain fired. The absolute idiocy of a federal agency to think that it has the authority to jump down into local jurisdictions without notifying local police of their actions and requesting assistance in something such as this is astounding, and very troubling. Local authorities might have just told them to consult the Constitution before displaying child like behavior. This is what everyone should do when a "federal agent"comes to the door, call 911 and tell them you have a suspected fake cop at the door. Let them sort it out. So, what was the final outcome? Did the purchaser of said shotgun have to comply with the non warrant? This type of thing is just so much excrement.

    Here's a clue Aaa Tee efF. If you're really supposed to be checking up on people who purchase firearms, which I highly doubt is within the law and of the supposed illegal regulations you guys come up with, instead of conducting a search without a warrant, send the agent in UNIFORM. I know you have them. That would at least lend some credibility to your illegal action. Oh, and get a warrant, which shouldn't be granted by any judge with any sense.

    Now, he's suing the uniformed officers for doing their job? Yah, the judge will laugh him out of court.

    Oh, one other thing. If in fact this guy shoplifted, why is he still employed by ATF?

  22. Why was he not wearing a uniform and showing his badge. Why did he not got there without notifying the local authorities and having one of them with him. Why is he working for ATF with a medical condition that makes it hard for him to breath when under stress. He wins my "Uber-douche" award and I'll bet he smells like Nancy Pelosi.

    but it does show us how to deal with the assholes who do shit like this. say ok and close the door and call 911 on their ass.
    had a friend who back in the 1990's bought a class 3 toy, the feds came to his work place and wanted to see the weapon,
    he had to leave work and show it to them. he sold it the next week.
    it seems like they can do that when you "own" a class 3 weapon. fuckers

    1. Owning a NFA item does not forfeit the owners 4th Amendment right. I do not doubt the scenario did not occur just as you stated (probably similar to these "agents" showing up and asking to see recently bought firearms). Before I purchased a Class III toy back in the mid-nineties, the first thing I did was check to see whether this "tale" was true or not. It is not. I think the origin of this rumor is in the regular FFL regulations where agents can make an annual unannounced "inspection" of records and weapons.

As much as I enjoyed watching him Get the exact over amped approach that I would Bet he puts American citizens through, considering the guy clearly wasn't holding a gun in his hands, the hyperventilating and acting like they had to make a man go face down while they, as in, more than one, had him covered from two directions was just ridiculous. Hell, Jerry Miculek wouldn't be able to get a shot off at either one of them and they were acting like they were in a deadly situation, while each of them had their guns in hand And Aimed at him. All they needed to do was have him keep hands up and turn around, so they could see if he was armed. If he was, all they needed to do was one keep him covered as the other takes the gun.Then let him show his badge. They seem to really get off on making a big deal out of everything and create drama. Anyone who wants to excuse their behavior at That is just policy. That is how they are trained. Yeah, there is a bad way to look at it. They are trained to escalate the tension unnecessarily. It's embarrassing to see how threatened they seem to feel when the only way the guy could possibly hurt them would be to detonate a suicide vest.
